Data protection information for applicants of the AIT Group

(AIT Austrian Institute of Technology GmbH ("AIT") and its subsidiaries Leichtmetallkompetenzzentrum Ranshofen GmbH ("LKR"), Nuclear Engineering Seibersdorf GmbH ("NES") and Seibersdorf Labor GmbH ("SL"))

1. Purpose and legal basis of data processing 

If you apply for a position with us, the personal data you provide ("data") will be processed in order to assess the possibility of employment with us and to consider your application for a position. 

For this purpose, we may also process data that you have made available via career or job portals to a wider public or to recruitment companies for job searches. 

After completion of the application process, your data will continue to be processed for the purpose of documenting a legally compliant recruitment process. 

Data processing is carried out on the legal basis of the fulfilment of (pre-)contractual measures according to Art. 6 (1) (b) of the General Data Protection Regulation ("GDPR") and for the fulfilment of legitimate interests according to Art. 6 (1) (f) GDPR. The legitimate interests pursued in this context are the filling of vacant positions with suitable candidates and, in connection with this, ensuring that positions are filled in accordance with the legal compliance obligations to which we are subject, the ability to prove that legally compliant recruitment processes have been carried out, and the exercise and defence of related rights and claims. 

Compliance obligations arise for us in particular from the Network and Information Systems Security Act (NISG) and export control and sanctions law, and may require us in individual cases to subject your data to a plausibility check by verifying the information you have provided in publicly accessible internet sources and with persons or bodies you refer to in your application documents, or by checking your data against sanctions lists. 

If you have given your explicit consent to the processing of your data in the course of your application or a recruitment process, data processing will also be carried out for the purpose specified in the declaration of consent. 

In this case, processing is carried out on the legal basis of your consent according to Art. 6 (1) (a) or Art. 9 (2) (a) GDPR. You can revoke your consent at any time with effect for the future. 

2. Data controller 

The AIT group specified in the respective job advertisement is responsible for processing your data. 

This may be:

Due to our data protection obligations, we would like to point out that your data may be processed by several AIT Group companies. It is possible that data processing may take place in the sense of ordered processing in accordance with Art. 28 GDPR or in the sense of joint controllers in accordance with Art. 26 GDPR. The reason for this is the organisational structure within the AIT Group, which has specialist departments for specific areas, such as recruiting. However, your data will only be processed by several AIT Group companies in compliance with the relevant data protection regulations. 

As a data subject, you are entitled to assert your rights as a data subject against any controller. In the event of joint controllership by several AIT Group companies, your corresponding request will be forwarded internally to the main controller responsible, who will process your request. The controllers support each other in this regard.

We process the data you provide in the course of your application. 

Furthermore, your data that you have made available via career or job portals to a wider public or to recruitment companies for job searches may be processed.

This includes the following data in particular: 

Name, date of birth, gender, nationality, address and addresses, social media contact information, telephone numbers, photograph, CV, cover letter, evidence of professional, educational and further training, and references.

5. Recipients and transfer to third countries

Your data will generally only be processed within the AIT Group. 

Data may be transferred to third parties in the following cases in particular: 

  • You are applying for a position at a subsidiary of AIT. Due to the organisational structure within the AIT Group, your data will be processed by AIT as a processor for the respective subsidiary.
  • To other processors, if they have been commissioned to process your data for us for the purpose of handling and documenting the recruitment process. One of our processors is eRecruiter GmbH, which provides the eRecruiter recruitment software we use.
  • If the job advertisement mentions that cooperation, project or research partners or partner universities are involved in the recruitment process, your data will be transferred to the organisations listed in the job advertisement in the course of the recruitment process.
  • To authorities or courts, if this is necessary to comply with and fulfil regulatory obligations. 

If your data is transferred to a recipient outside the EU or the European Economic Area (EEA), the transfer will only take place in compliance with the relevant legal provisions of Articles 44-46 GDPR

6. Storage period

For the purpose of documenting a non-discriminatory recruitment process and to provide evidence of compliance with our compliance obligations listed in point 1, your data will generally be stored for a period of 7 months after completion of a specific recruitment process. The period begins anew with each application. 

In justified individual cases, data may be stored for a longer period if necessary to comply with the obligations listed in point 1, or for security reasons such as protecting life and limb.

If your data is processed on the basis of consent, data processing will take place for the period specified in the consent form or until you withdraw your consent. 

7. Data protection rights and right to lodge a complaint

You have the right to access your stored data at any time. You also have the right to have data corrected or deleted. You have the right to request the restriction of the processing of your data or its transfer. In addition, you have the right to object to the processing of your data and to contact the data protection authority in the event of a suspected violation of data protection regulations. If your data is processed on the basis of your consent, you can revoke this consent at any time. However, revocation does not affect the lawfulness of the processing up to the point of revocation.

You can exercise your right to rectification at any time, for example by logging into the online self-service zone of the career portal with your personal access data and changing your data yourself. Requests for updates can also be made by email to jobline(at)ait.ac.at.

You can request the deletion of your entire application profile and your account at any time, for example by sending an email to jobline@ait.ac.at. Please note that deletion requests can only be complied with if there are no interests or reasons that legally compel or entitle us to continue processing your data.

You can revoke your consent to data storage in the evidence database at any time. You can revoke your consent by sending an informal email to jobline(at)ait.ac.at or by changing your settings in the self-service zone of the career portal.

8. Obligation to provide personal data

You are not obliged to provide your data. However, if you do not provide your data, we cannot consider you for a position.

9. Automated decision-making, including profiling

There is no automated decision-making, including profiling, in accordance with Art. 22 GDPR.
